1. Introduction

MECFox Engineering Solutions Private Limited (referred to as "we", "us", or "our" in this agreement) welcomes you to HawkingPath, our branded platform and services. By accessing or using HawkingPath, you (the user, referred to as "you" or "your") agree to be bound by these Terms and Conditions (hereinafter "Terms"). If you don't agree to all the Terms, you cannot access or use HawkingPath. This clarifies that MECFox Engineering Solutions Private Limited owns and operates HawkingPath, ensuring transparency and accountability.

2. User Accounts

To access certain features of our platform, you may be required to create an account. You are responsible for maintaining the confidentiality of your account information, including your password. You are also responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account or any other security breach.

3. Content and Intellectual Property

The content on our platform, including text, graphics, logos, images, audio, video, downloads, and other materials (collectively, "Content"), is the intellectual property of HawkingPath or its licensors. You may not modify, copy, reproduce, distribute, transmit, display, perform, licence, create derivative works from, transfer, or sell any Content, without our prior written consent.

4. User Conduct

You agree to use our platform in a respectful and responsible manner. You agree not to:

  • Violate any applicable laws or regulations.
  • Infringe the intellectual property rights of others.
  • Upload or share any content that is defamatory, abusive, harassing, threatening, or discriminatory.
  • Use our platform for any commercial purpose without our prior written consent.
  • Interfere with the functionality of our platform.
5. Payment

If you purchase a paid course or service on our platform, you agree to pay all applicable fees and charges. We reserve the right to change our prices at any time.

6. Refund Policy: 90% Refund within 15 Days, Limited Video Viewing

This policy outlines the terms for receiving a refund for your purchase on HawkingPath.

Eligibility

To be eligible for a 90% refund, you must request it within 15 days of your purchase date. Additionally, you must have watched less than 30 minutes of total video content across all courses within those 15 days.

Refund Amount

If you meet the above criteria, you will receive a 90% refund of your purchase price. The remaining 10% covers processing fees and administrative costs.

Ineligible for Refunds

You will not be eligible for any refund if:

  • You request it after 15 days of your purchase date.
  • You have watched more than 30 minutes of total video content across all courses within 15 days.
  • You violate any terms and conditions of our platform.

Processing

To request a refund, please contact us at support@hawkingpath.com within the 15-day window. Be sure to include your name, order number, and the reason for your request. We will process your request within 15 business days. The refund will be issued to the original payment method used for the purchase.

7. Disclaimer of Warranties

OUR PLATFORM AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR VIRUS-FREE.

8. Limitation of Liability

WE SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING OUT OF YOUR USE OF OUR PLATFORM OR SERVICES, INCLUDING, BUT NOT LIMITED TO, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, AND PUNITIVE DAMAGES.

9. End of Service

We reserve the right to terminate the Platform or any of its services at any time without notice. In the event of termination, we will use reasonable efforts to provide you with advance notice and, if possible, offer you the opportunity to download your course materials. We will not be liable for any loss or damage caused by the termination of the Platform or any of its services.

10. Course Validity and Enrollment Timeline

Course Validity: Once enrolled, each course will be valid for access for a maximum of one (1) year from the enrollment date. This means you will have one year to complete the course and access its materials.

Enrollment Timeline: You must enroll in all purchased courses within three (3) months from the date of purchase. After this period, any unenrolled courses will be automatically forfeited.

Exceptions to End of Service and Enrollment Timeline

These provisions regarding end of service and enrollment timeline may be subject to change in specific circumstances, such as:

Technical outages or unforeseen circumstances: If service is interrupted due to technical issues or other unforeseen circumstances, we will make reasonable efforts to restore service as soon as possible and may extend course validity periods accordingly.

Subscription plans: If you are subscribed to a recurring payment plan, the enrollment timeline and course validity may differ based on the specific plan terms.

11. Eligibility Criteria for Career Services

Access to career services on the Platform may be subject to specific eligibility criteria. To be eligible for career services, you must meet the following requirements:

Purchase Executive Program: You must have purchased the Executive Program on the Platform. This ensures you have access to the necessary resources and curriculum designed to prepare you for career advancement.

Complete Mandatory Courses: You must successfully complete all mandatory courses within the Executive Program. Completion implies achieving a minimum score of 80% in each course. This demonstrates your understanding of the key concepts and skills essential for career development.

Complete Mandatory Assessments and Projects: You must complete all mandatory assessments and projects included in the Executive Program on time and to a satisfactory standard. These activities are designed to help you apply your learnings and showcase your skills to potential employers.

Please note that these eligibility criteria may be subject to change. We recommend checking the Platform and our communications for updates on the latest requirements for accessing career services.

Exceptions to Eligibility Criteria

In exceptional circumstances, we may consider granting access to career services even if you do not meet all the above criteria. This may be the case for:

Technical issues or unforeseen circumstances: If you were unable to complete mandatory courses or assessments due to technical issues or other unforeseen circumstances beyond your control, we may consider alternative solutions on a case-by-case basis.

Demonstrated initiative and progress: If you can demonstrate exceptional initiative and progress in your learning journey, even without meeting all the formal requirements, we may consider granting you access to career services on a conditional basis.

12. Clarification on Placement Opportunities

While our platform equips you with the knowledge and skills necessary for career advancement, we do not directly provide job placements, interviews, or guarantee employment. Our focus lies on supporting your learning journey and preparing you for career success by:

  • Offering comprehensive courses and programs designed to develop industry-relevant skills.
  • Providing access to career resources, including workshops, resume and cover letter guidance, and interview preparation tips.
  • Connecting you with a network of industry professionals and alumni through community forums and events (where applicable).

Please note that ultimately, securing employment depends on various factors, including your individual qualifications, job market conditions, and your own proactive efforts in applying and interviewing for opportunities.

Course Materials: All course materials, including lectures, assignments, assessments, and other resources, are provided for your individual learning journey and cannot be shared or distributed without our permission.

Intellectual Property: All intellectual property rights associated with the learning materials belong to us or our licensors. You may not copy, modify, distribute, or create derivative works from these materials without our express written consent.

Academic Integrity: We expect all users to uphold academic integrity and avoid any form of cheating, plagiarism, or misuse of learning materials. Violations of these principles may result in disciplinary action, including suspension or termination of your account.

Language of Instruction

English is the primary language of instruction for all programs and resources on our platform. If you require translation assistance, you may need to utilise external tools or resources at your own expense.

Unauthorised Recording

Recording of any course content, audio, video, or other materials hosted on our platform is strictly prohibited without our prior written consent. This includes capturing lectures, discussions, assessments, or any other components of the learning experience.

Violation of this policy may result in disciplinary action, including suspension or termination of your account.

Your use of these tools is at your own discretion and subject to the terms and conditions of their respective providers.

15. Governing Law, Jurisdiction and Dispute Resolution

Governing Law and Jurisdiction

These Terms are governed and interpreted by and construed in accordance with the laws of the Republic of India and subject to the dispute resolution clause below, the court at Chennai shall have sole and exclusive jurisdiction over all matters arising out of or relating to the Terms. You agree and undertake not to initiate or instigate any class actions.

Dispute Resolution

Any and all disputes arising out of or in connection with these Terms shall be exclusively submitted to arbitration under the Arbitration and Conciliation Act, 1996, and shall be adjudicated by an arbitral tribunal comprising a sole arbitrator to be appointed by mutual consent of the parties. All proceedings of the arbitration shall be conducted in English language. The venue and seat of arbitration shall be Chennai. The arbitration award rendered by the sole arbitrator shall be final and binding. The substantive and procedural laws applicable to these Terms shall be the laws in force in the Republic of India.

16. Entire Agreement

These Terms constitute the entire agreement between you and us with respect to your use of our platform and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.

17. Changes to Terms

We may modify these Terms at any time. Your continued use of our platform following any such modification constitutes your acceptance of the modified Terms.
